By using our platform, you represent and warrant that you are at least 18 years of age, or that you are accessing the platform under the supervision of a parent or legal guardian who agrees to these terms on your behalf. If you are accessing the platform on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

Certain features of the platform may require you to create an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
3.2 Account Security
You agree to notify us immediately at contact@bepooke.club if you become aware of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.
3.3 Account Termination
We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, if we believe you have violated these terms or engaged in conduct that is harmful to other users, third parties, or the platform.
4. Use of the Platform
4.1 Permitted Use
You may access and use the platform solely for lawful, personal, and non-commercial educational purposes, unless a separate written agreement with Gothermyx authorizes otherwise. You agree to use the platform in compliance with all applicable laws and regulations.
4.2 Prohibited Conduct
You agree not to engage in any of the following activities:

All content available on the Gothermyx platform, including but not limited to course materials, lecture recordings, written texts, graphics, interfaces, logos, and software, is the exclusive property of Gothermyx or its content licensors and is protected by applicable intellectual property laws.
5.2 Limited License
Subject to your compliance with these terms, Gothermyx grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform content solely for your personal, non-commercial educational purposes. This license does not include the right to reproduce, distribute, publicly display, or create derivative works from any content without express written authorization.
5.3 User-Submitted Content
If you submit, upload, or otherwise provide any content to the platform, you grant Gothermyx a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, and distribute such content in connection with operating and improving the platform. You represent that you own or have the necessary rights to grant this license and that your content does not infringe any third-party rights.
6. Third-Party Links and Services
The platform may contain links to third-party websites, tools, or services that are not owned or controlled by Gothermyx. We provide these links for convenience only and do not endorse or assume any responsibility for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms.
7. Privacy
Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. By using the platform, you consent to the collection and use of your information as described in the Privacy Policy. We encourage you to review the Privacy Policy carefully.
8. Fees and Payments
8.1 Pricing
Certain features or content on the platform may be offered for a fee. All applicable fees will be clearly disclosed before you complete a purchase. Prices are shown in Canadian dollars unless otherwise indicated and are subject to applicable taxes.
8.2 Billing
By providing payment information, you authorize Gothermyx or its designated payment processor to charge you the applicable fees. You are responsible for ensuring your payment information is accurate and up to date.
8.3 Refunds

9. Disclaimers
The platform and all content are provided on an as is and as available basis without warranties of any kind, either express or implied. Gothermyx expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any content available through the platform. Educational content is provided for informational purposes only and does not constitute professional advice.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Gothermyx and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to your access to or use of, or inability to access or use, the platform or its content.
In no event shall our aggregate liability to you exceed the greater of the total fees you paid to Gothermyx in the twelve months preceding the claim or one hundred Canadian dollars (CAD $100.00).
11. Indemnification
You agree to indemnify, defend, and hold harmless Gothermyx and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the platform, your violation of these terms, or your infringement of any third-party rights.
12. Modifications to the Platform
Gothermyx reserves the right to modify, suspend, or discontinue any aspect of the platform at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the platform or any part thereof.
13. Governing Terms
These Terms of Use, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Gothermyx with respect to your use of the platform and supersede all prior or contemporaneous communications and proposals, whether oral or written.
If any provision of these terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision.
